FOR POLICYHOLDERS

Not all consumer problems can be economically pursued by an attorney. Unfortunately, there are certain types of cases where the cost of hiring an attorney can exceed the value of the dispute itself. Many consumer problems can be resolved by contacting the Florida Department of Insurance through their website (Florida Department of Financial Services) at www.fldfs.com or through the Consumer Help Line at 800-342-2762. Please avail yourself of this free service before contacting an attorney.

For those situations that cannot be resolved amicably and where an attorney must be retained, it is best if the policyholder prepares for consultation in advance of contacting me. Here is how to prepare:

FIRST: Assemble your papers in one place and organize them into logical categories (i.e. Policies/notices/endorsements, Premium Notices, Claim Notices/documents claiming your losses, correspondence to and from the claims adjuster).

SECOND: Prepare a short narrative of what happened, when it happened, and why (CAUTION - if this information is confidential, YOU MUST NEVER SHOW IT TO ANYONE EXCEPT ME!)

THIRD: If after contacting me you are asked to send documents for a review, MAKE COPIES - DO NOT SEND THE ORIGINALS AND DO NOT SEND YOUR CASE MATERIALS WITHOUT FIRST CONSULTING ME (I am sorry but I cannot accept unsolicited materials for review and will return them without action).

FOURTH: Just because you have made contact with me and have sent materials for review DO NOT ASSUME THAT I HAVE RECEIVED THEM. If I do not contact you and acknowledge receipt within seven (7) days of mailing, you should contact me for confirmation.

FIFTH: Just because you have sent me materials, DO NOT ASSUME THAT I AM REPRESENTING YOU! If I agree to represent you, I will send you a contract to sign and return. If you haven't signed anything, I Am Not Representing You! These are just some of the terms and conditions that must be strictly followed as a condition precedent for me to represent you.

Remember that the Statute of Limitations is running out on your claim and YOU must do things in a timely manner or your claim may be time barred. If you have a claim, do not sit on it; it will not get better with time.
