  • Jane Doe v. New York Life,
    United States District Court. Ten million dollar breach of contract claim filed against the insurance company for its refusal to pay benefits on the reported death of Odessa (Ukraine) City Councilman who fabricated his death to evade the vengeance of Russian Mobsters. One month after litigation was filed, the Insured's body was discovered defenestrated from a nine story building and the insurance company claimed that the Insured's attempted fraud voided the coverage. Complaint was amended to reflect actual date of death (thirteen months after first reported death) and the action proceeded; CPR traveled to the Ukraine for exhumation of the insured's body and returned with bone tissue for DNA identification; DNA verified death of the Insured. Court held: Policyholder entitled to death benefits without regard to purported fraud by the Insured.

    Alamo Rent-A-Car
    ,
    Florida Circuit Court. Multi-Million Dollar wrongful death claim upon life of visiting Cuban Minister killed in a Florida rental car. Defense contended decedent's death resulted in no wage loss claim as Cuban Minister and his family lived on equivalent of $14.00 per month. CPR traveled to Havana to conduct discovery and action proceeded to trial. Settled during trial: Widow and three minor children entitled to multi-million dollar recovery.     Florida Circuit Court. Insurance Agent brought Ninety-three million dollar claim against insurance companies for breach of contract, anti-trust, and defamation. Trial court permitted punitive damages against insurance companies. Settled before trial: Significant monetary settlement under strict confidentiality stipulation.

  • Florida Department of Insurance v. John Doe,
    Florida Administrative Revocation action brought by Florida Department of Insurance against agent for alleged violation of Surplus Lines Law in connection with sale of package insurance to condominium association.
